How to Shop

Shopping in the e-shop on www.bonaloka.cz located on https://www.bonaloka.cz/en/eshop/ (hereinafter referred to as the “E-shop”) is very easy and comfortable.

1. Seller and seller’s contact details

1.1. The seller of the goods in the E-shop is BONALOKA s.r.o., Company ID No.: 050 21 189, having its registered office at Praha 4 - Krč, Antala Staška 510/38, Postcode 140 00, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Entry 2571429.

1.2. If you need advice concerning your shopping or choice of goods, if you need to determine the status of your order, complain about goods or receive other information, do not hesitate to contact us by phone on +420 225 988 008, by e-mail at info@bonaloka.cz, in writing at BONALOKA s.r.o., Velké Kunratické 1570/3a, 148 00 Praha 4, via the web form on www.bonaloka.cz or in another manner.

2. Offer of goods

2.1. The E-shop contains an up-to-date offer of goods that you can order comfortably from your home. The E-shop contains information on our news, promotional offers, discounts or clearance sales.

2.2. All products offered are photographed, marked with their commercial name and described or otherwise characterised in detail, including, in particular, information on the composition, durability, method of use, recommended dosage and warnings. By sending an order, you confirm that you have properly acquainted yourself with this information. Contact us should you have any questions.

2.3. Each product shows the price for the stated packaging, which already includes the relevant value added tax (hereinafter referred to as “VAT”); you do not pay any other taxes or fees for the products ordered that are not included in this price, except for the selected method of transport and payment, of which you will be informed during the shopping process.

2.4. Goods are available for purchase in the E-shop if a red shopping basket icon is displayed which you can click on. Otherwise the goods are not available. The availability of goods may change during the shopping process. Thank you for understanding and respecting this fact. If, exceptionally, we were unable to deliver the goods ordered by you, we will inform you immediately.

2.5. The availability of the goods offered in the E-shop depends on stock, therefore we cannot guarantee the availability of all products. Unfortunately, we are not able to determine in advance whether and when a sold-out product will be available again. It is possible, however, that the sold-out product will appear in our E-shop offer later. Contact us should you have any questions concerning product availability.

3. Shopping basket

3.1. Select a specific product, its packaging and quantity from the offer in the E-shop. Click on the shopping cart icon of the desired product to add the goods to your shopping “Basket”. Once the goods are added to the Basket, you will be informed via notification “The product was added to the basket”, which contains an active link to the Basket. This is also displayed at the top right corner of the screen. Click on the Basket to see a window with your shopping basket.

3.2. In the first “Basket” step “Select country” from the displayed list of countries to which the goods are to be delivered. Borders are not an obstacle for us; however, transport outside the territory of the Czech Republic is only possible to the listed countries. If you choose a country other than the Czech Republic as the place of delivery, please note that the transport and payment options, the amount of costs, taxes and fees, as well as the delivery period will be different from those connected to delivery within the territory of the Czech Republic depending on the specific place of delivery of the goods. You will be informed of these conditions during the shopping process.

3.3. The screen with your shopping basket shows an overview of the “Products” that you have put into the Basket, broken down into “Product name”, “Quantity”, “Unit price” and “Total price”. You can increase or decrease the number of pieces for each of the products by clicking on the plus or minus symbols shown by the selected number of pieces. You can remove any item from the list of Products from the shopping basket by clicking on the cross icon in a red circle (“Remove-from-Basket”) that is displayed for each item of the “Products” in the last column under “Total price”. You can add a product into the shopping basket by clicking on the link “Back to E-shop”, which will take you back to the E-shop offer.

3.4. The overview with the “Products” shows both the total “Price for goods without VAT” and the total “Price for goods incl. VAT” and, in addition, using a larger font “Total price incl. VAT”, which is the price of all the products in the Basket in the required packaging and quantity increased by the costs of transport and payment method, if any, which you choose within the second step of the shopping process on the “Transport and payment” page. Along with the price information, you will see how much you need to buy in order to get FREE Transport or be able to make use of promotional offers. You will be informed of the total order price including all taxes and charges before sending the order by clicking on the “Buy” icon.

3.5. On your shopping basket screen, you can enter a discount code or voucher you have received from us in the displayed “Discount code / Voucher” box and confirm its entry by clicking on the arrow in the box. If the discount code or voucher are not entered correctly or if they are not valid or have already been used, the message "No code found" will be displayed. Otherwise, the discount code is reflected in the total price incl. VAT displayed. Contact us should you have any troubles.

3.6. After clicking on “Continue order”, the second screen of the shopping process will be displayed – “Transport and payment”.

4. Transport

4.1. In the first step of the second screen “Transport and payment”, you will first select the “Method of delivery”.

4.2. We will deliver the goods to you to the address you select via PPL CZ s.r.o. or Geis Parcel CZ s.r.o. You can also have your goods delivered to any of the parcel shops of Uloženka s.r.o. If you select “Uloženka”, the consignment will be stored in one of the Uloženka shops, which you choose from the displayed list of shops after choosing the “Uloženka” option. It is possible to collect goods in person from BONALOKA s.r.o., Velké Kunratické 1570/3a, 148 00 Praha 4; to do so, you must choose the respective option and make an agreement.

4.3. We send goods within the entire Czech Republic and borders are not an obstacle for us either. We will be happy to deliver goods to any of the countries listed in the list of countries in the first step of the shopping process “Basket” under the item “Select country”.

4.4. If you want to have your goods delivered outside of the Czech Republic, the order will be created in the usual manner. In the first step of the shopping process “Basket” under the item “Select country” you will select the respective country from the list of countries; unfortunately, we do not deliver goods to countries that are not included in the list. We send goods outside of the Czech Republic after prior payment of a pro-forma invoice by bank transfer, the invoice for which we will send to you to the e-mail address provided by you, and the invoiced amount will be converted to Euro. The delivery time from completion of the order and crediting the payment in our account depends on the selected method of transport, but it usually takes 5-10 working days. Shipments outside of the Czech Republic are delivered via contractual carriers and in some cases also through the parcel shops of our contractual partners.

4.5. Use free transport within the entire Czech Republic when purchasing goods above CZK 2,000 or when collecting the goods in person. If you order goods for less than CZK 2,000 and do not choose to collect them in person, you will pay CZK 87 for transport of the goods within the Czech Republic via Geis or CZK 114 for transport via PPL; if you have your goods sent to a parcel shop of “Uloženka”, you will only pay CZK 83. The transport costs will be added to the price for the goods. You will be informed of the transport price during the shopping process. If the prices specified herein differ from the prices stated during the shopping process, the prices displayed within the purchasing process shall apply. If we need to split the order into multiple shipments, you will only pay the transport costs of one of them.

4.6. On the date of delivery, the driver will inform you of the approximate delivery time by phone or by SMS. If the date or address does not suit you, you can change them here for the PPL services and here for the Geis services. If you have your goods sent to any of the parcel shops of “Uloženka”, you can collect them during the opening hours of the particular shop. To collect a consignment, you will need the consignment number that will be sent to you.

4.7. The method of transport and the costs associated with the delivery of goods outside of the Czech Republic differ from the delivery within the Czech Republic. The costs associated with the delivery of goods outside of the Czech Republic depend on the country of delivery, the selected method of delivery and the current price list of the carrier. You will be informed of the individual delivery methods and the amount of costs associated with transport outside of the Czech Republic during the shopping process.

5. Payment

5.1. In the second step of the “Transport and payment” screen, select the “Payment method” or click on the “Return” icon located in the bottom left corner of the screen to return to the “Basket” and back to the E-shop.

5.2. We offer the possibility to pay by cashless bank transfer or in the form of cash on delivery for goods delivered within the Czech Republic. Orders outside of the Czech Republic shall only be sent after prior payment of a pro-forma invoice by bank transfer, the invoice for which we will send to you with the relevant payment data to the e-mail address you have entered, and the invoiced amount will be converted into Euro.

5.3. If you choose “Bank transfer” as the payment method, we will send to you the respective payment data to the e-mail address specified by you. The order and delivery of the ordered goods will only be completed after the payment has been credited in our account. If the payment is not made by the set due date, we will cancel the order.

5.4. In the event of the cash on delivery option you will pay for the goods upon the takeover thereof. You may only pay in cash upon delivery of the goods to your chosen address; payment by card is only possible if the carrier or parcel shop you have chosen accept cards, which we will inform you of. Cash on delivery is subject to a fee of CZK 30, even if you get free transport.

5.5. We only accept payment by card or in cash when the goods are collected in person. Under the Sales Registration Act, we are obliged to issue a receipt to you and, at the same time, we are obliged to register the received sales with the tax administrator online; in the event of a technical failure within 48 hours at the latest.

5.6. After clicking on “Continue order”, the third screen of the shopping process, “Delivery data”, will be displayed.

6. Delivery data

6.1. If you are a registered user and you have your user account with us, it is sufficient to click on the “Log-in” icon on the third screen of the purchasing process, “Delivery data”, and log in by entering your e-mail address and password. If you have forgotten your login password, click on the “Forgot your password?” link and follow the displayed instructions.

6.2. If you are not yet a registered user and want to take advantage of a user account, you can register with us free of charge either by clicking on the “Log in” icon located on the “Delivery data” screen and then clicking on “Register”, which will direct you to the registration form, or via the “Registration” icon located on the main page of the www.bonaloka.cz website.  The conditions of registration and maintenance of user accounts are available here. 6.3. If you want to purchase without logging in, it is sufficient to complete all the data with an asterisk that is mandatory on the third screen of the purchasing process “Delivery data”. Contact and invoicing data including name and surname, e-mail address, telephone number and invoicing address is mandatory. We will send to you all information relating to your order to the completed e-mail address. If you wish to buy goods on behalf of a company or need your goods to be sent to a different address or want to write a note to the order, mark the respective box according to your requirement and complete the required data. If you are buying goods on behalf of a company, we need to know the company name, ID No. and VAT Reg. No.; if the goods are to be sent to a different address, we need to know the name, surname, street, town and postcode, and if you want to write a note, a text box will be displayed under “Is there anything else we should know?”

6.4. We treat the provided personal data in accordance with applicable legal regulations and in respect to your right to privacy. More information on privacy protection and security is available here.

6.5. After clicking on “Continue order”, the last screen of the purchase process, “Summary”, will be displayed. If you want to go back by one or more steps, click on the “Back” icon located in the bottom left corner of the screen.

7. Summary

7.1. In the last, fourth screen of the shopping process, which is “Summary”, you will have the possibility to check and change the data you provided during the individual steps of the shopping process or correct errors made when entering the data, or you can cancel the order completely. You can change or correct the data either in the shopping basket or in relation to the selected method of transport and payment and/or delivery data on the appropriate screen which you can return to by clicking on the “Back” icon located in the bottom left corner of the screen. Having made the change, click on the “Continue order” icon again. The data you have already entered in the order will be retained. You are responsible for the completeness, accuracy and truthfulness of the data, which we are not obliged to verify, and we shall not be held liable for the non-compliance thereof.

7.2. Before sending it, you are allowed to familiarise yourself with the Business Terms and Conditions for Purchase via E-shop, which form an integral part of the purchase agreement (on the delivery of goods) and which are located on www.bonaloka.cz. To send an order, you must check the consent box to these Business Terms and Conditions. By checking it and sending the order, you confirm that you have become familiar with the Business Terms and Conditions and that you agree with them. Without expressing your consent to the Business Terms and Conditions, it is not possible to conclude a purchase agreement with respect to the goods.

7.3. In addition, you are obliged to familiarise yourself with the privacy policy set out in the Terms and Conditions of Use of the www.bonaloka.cz Website and Privacy Protection, which are available on www.bonaloka.cz. By sending an order, you expressly confirm having done so.

7.4. Click on the “Buy” icon to send an order, which will make your order binding.

8. Conclusion of the purchase agreement

8.1. The purchase agreement can be concluded in Czech. Other language versions of the E-shop website are only indicative and not binding. Should there be any differences between the individual language versions, the Czech version shall prevail. We keep the concluded purchase agreement in the electronic form and you are the only person with access to it.

8.2. The purchase agreement is concluded upon delivery of information on acceptance of the order, which we will send to you. If you do not receive confirmation from us within a few hours, check the unsolicited mail folder (so-called spam) first. If you do not find the confirmation there, contact us. If you shopped without registration, you will be asked to indicate the e-mail address you used for your shopping.

8.3. By sending an order, you give your consent to the use of distant means of communication for the purchase agreement conclusion. You are responsible for all costs incurred in association with using such means of communication during the conclusion and performance of the purchase agreement (costs of the internet connection and related costs, if any, such as costs of phone calls).

8.4. Let us inform you that we do not have an obligation to conclude a purchase agreement, especially with persons who have materially violated their obligations towards us.

8.5. Once an order has been sent out and we have confirmed the acceptance thereof, it is passed to our colleagues, who will take care of it. If you wish to change or cancel an order, contact us without delay.

9. Withdrawal from the purchase agreement

9.1. You may withdraw from the concluded purchase agreement without giving a reason and without being penalised in any way within 14 (fourteen) days of receipt of the goods. You must inform us of the withdrawal no later than on the last day of the period of 14 days, as specified above. You can use this template form to inform us of your withdrawal and send it to our info@bonaloka.cz e-mail address.  Withdrawal from the purchase agreement is excluded in cases specified in legal regulations, in particular in the provisions of Section 1837 of Act No. 89/2012 Coll., the Civil Code, as amended.

9.2. You are required to send the goods received from us within 14 days of the withdrawal by regular mail (not cash on delivery) to BONALOKA s.r.o., Velké Kunratické 1570/3a, 148 00 Praha 4. If you choose other than the cheapest method of delivery offered to return the goods, we will reimburse you for the cost of delivery of the goods in the amount corresponding to the cheapest method of delivery offered; you will bear the remaining costs of returning the goods.

9.3. You are obliged to return the goods in a complete and undamaged condition, with all related documents and in the original packaging; pack the goods so that they cannot become damaged during the transport back to us. We will otherwise have to set off the amount corresponding to the decrease in the value of the goods against your right to a refund of the purchase price. If you have also received a gift from us along with the goods, you are obliged to return it to us along with the goods that were the subject of the purchase agreement you are withdrawing from.

9.4. If you withdraw from the purchase agreement, we will return to you all the money including the costs of delivery that we received from you under the purchase agreement using the same method you used to pay the amount to us, which we will do within 14 days of the withdrawal from the agreement, however, not before we receive the goods from you or you credibly prove to us you have duly sent the goods. We will only return them to you using a different method if agreed with you and provided you do not incur any other costs. If you paid for the goods in the form of cash on delivery, we will contact you upon receipt to indicate your bank account number.

9.5. If you used a discount voucher or another voucher for the purchase of goods you are withdrawing from, it will no longer be valid and cannot be used to buy other goods.

10. Complaints

10.1. We are very sorry if you are forced to complain about any goods and we apologise for any and all troubles.

10.2. As for perishable goods, defects must be claimed without undue delay after receipt, not after the period during which the goods may be used. As for consumable goods, defects must be claimed within the indicated period of the shortest shelf life. As for consumer goods, defects must be claimed within 24 months of the goods receipt or within an extended warranty period specified on the goods, on the packaging, in the instructions accompanying the goods or in advertising.

10.3. To lodge a complaint, you can use our info@bonaloka.cz e-mail address or our web form available on www.bonaloka.cz.  At the same time, send the goods to us via ordinary mail (not cash on delivery) to the address of BONALOKA s.r.o. The moment of the faulty performance right exercise shall be deemed the moment that we receive the claimed goods from you.

10.4. In your complaint indicate the order number or demonstrate in another provable manner when and at what price you bought the goods in the E-shop, and describe the defect in the goods as precisely as possible, or take a picture of it to facilitate quick handling of the complaint. We accept goods for a complaint procedure in a clean and hygienic condition corresponding to good manners.

10.5. We will issue to you a complaint acceptance certificate. We will make every effort to handle your complaint and remove the defect without undue delay, specifically within 30 days of the lodging thereof, unless we arrange a longer period of time with you. After vain expiry of that time period you are entitled to withdraw from the purchase agreement.

10.6. If the goods show a defect and if the defect can be removed without undue delay, you are entitled to have the defect removed free of charge. If the goods show a defect, you can also require delivery of new goods free of any defects unless it is inappropriate with regard to the nature of the defect. If you cannot use the goods properly due to repeated occurrence of defects after repair or due to a greater number of defects, you are entitled to receive new goods from us or withdraw from the purchase agreement. If you do not withdraw from the purchase agreement or if you fail to exercise your right to delivery of new goods free of any defects, to replacement of a part of the goods or to repair of the goods, you can require an adequate discount of the purchase price. You are also entitled to an adequate discount if we are not able to deliver to you new goods free of any defects, replace a part of the goods or repair the goods, or if we do not remedy the defective condition within an appropriate time period or if remedy of the defective condition causes remarkable difficulties to you.

10.7. We will reimburse you for the costs of the complaint in the amount corresponding to the cheapest method of delivery offered; you will pay the remaining costs associated with return of the goods.

11. Settlement of disputes

11.1. Should you have any complaints, you can contact us in person, by phone, by e-mail or in writing. Our contact details are available here.

11.2. If you are not satisfied with the resolution of your complaint, you can contact the Czech Trade Inspection Authority, with its registered office at Praha 2, Štěpánská 567/15, Postcode 120 00. More information is available on the website of the Czech Trade Inspection Authority www.coi.cz.

11.3. If you need out-of-court assistance with settlement of a dispute with us arising out of the purchase agreement, you can make use of the online dispute settlement platform established by the European Commission on http://ec.europa.eu/consumers/odr/ pursuant to Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No. 2006/2004 and Directive 2009/22/EC (Regulation on consumer ODR). The contact point according to this regulation is the European Consumer Centre of the Czech Republic, which is located at Praha 2, Štěpánská 567/15, Postcode 120 00, and which you can also contact for this purpose. 11.4. Let us inform you that we are not bound by any codes of conduct in relation to you within the meaning of Section 1826 (1)(e) of Act No. 89/2012 Coll., the Civil Code, as amended.

12. Final provision

12.1. This pre-contractual information shall apply from 1 April 2018.
